Terms & Conditions
Wilkinson Home Solutions
These Terms & Conditions form part of the agreement between Wilkinson Home Solutions (“the Contractor”) and the person or entity accepting a quote or authorizing work (“the Client”). Approval of a quote or authorization to proceed with work constitutes acceptance of the terms outlined below.
1. Quotes, Pricing, and Validity
Quote Validity
Quotes are valid for 30 days from the date issued unless otherwise stated. After this period, pricing and availability may be subject to change.
Estimates and Unforeseen Conditions
Quotes and estimates are based on visual inspection and the information available at the time of quoting. Additional costs may arise where unforeseen conditions are encountered, including but not limited to hidden damage, structural issues, or changes to project scope. Any additional work will be discussed with the Client prior to proceeding.
Pricing Adjustments
Pricing may be adjusted where material costs, supplier pricing, transportation costs, or government-imposed tariffs or duties change between the time of quoting and project completion. The Client will be notified of any adjustments prior to final invoicing.
2. Scope of Work
Defined Scope
Only work specifically described in the approved quote is included. Work not expressly listed is excluded unless added through written approval.
Work by Others
Wilkinson Home Solutions is not responsible for the work, scheduling, or performance of other contractors or trades unless explicitly agreed upon in writing. Coordination with other trades may be provided at an additional cost where requested.
Specialized or Licensed Work
Work requiring licensing outside the Contractor’s scope of practice (including but not limited to electrical or plumbing work) will be completed by appropriately licensed subcontractors where required. Costs associated with such work are not included unless stated in the quote.
3. Materials and Workmanship
Standard of Work
All work will be completed in a professional manner consistent with generally accepted industry standards.
Material Selection and Availability
Materials will be selected based on suitability, availability, and project requirements. If specified materials become unavailable, equivalent alternatives may be used. The Client will be informed of any material substitutions where applicable.
Client-Supplied Materials
Wilkinson Home Solutions is not responsible for defects, performance issues, or warranty concerns arising from materials supplied by the Client or third parties.
4. Project Changes
Changes requested after work has begun may result in additional costs or changes to scheduling. Any changes to scope or materials will be confirmed prior to proceeding.
5. Site Conditions and Existing Structures
The Contractor is not responsible for pre-existing conditions, hidden defects, or concealed damage that becomes visible during the course of work. Where such conditions are discovered, work may be paused and additional costs or scope changes may be required to proceed safely.
The Contractor is not responsible for damage resulting from deterioration, improper previous installation, or conditions beyond reasonable visual inspection.
6. Access and Working Conditions
The Client agrees to provide safe and reasonable access to the work area. The Contractor reserves the right to delay or suspend work where conditions are unsafe, inaccessible, or where required preparations have not been completed.
Delays caused by access issues, scheduling conflicts, or site readiness may result in additional charges.
7. Utilities and Site Facilities
The Client agrees to provide reasonable access to electricity, water, heat (where seasonally required), and restroom facilities for the duration of the work. These utilities are necessary for safe and efficient completion of the project and are considered part of normal site access.
If utilities or facilities are not available, alternative arrangements may result in additional costs or scheduling adjustments.
8. Surface and Finish Limitations
The Contractor will take reasonable care to protect existing finishes and surfaces; however, minor cosmetic impacts may occur during normal construction or repair activities. Exact matching of existing materials, finishes, paint colours, or textures cannot be guaranteed.
9. Delays Outside Contractor Control
The Contractor is not responsible for delays caused by material shortages, supplier delays, weather conditions, manufacturer backorders, or scheduling delays related to other trades or third parties.
10. Warranty Limitations
Warranty coverage applies only to workmanship performed by Wilkinson Home Solutions and does not extend to failures caused by misuse, lack of maintenance, normal wear and tear, environmental conditions, or defects in manufacturer-supplied materials.
Manufacturer warranties apply separately where applicable.
11. Client Responsibility for Product Use
The Client is responsible for the proper use and application of any materials supplied or installed where ongoing use or maintenance is required. The Contractor is not responsible for damage resulting from improper application, environmental conditions, or use outside manufacturer recommendations.
12. Termination
Right to Terminate
Either party may terminate the agreement for valid reasons, including non-payment, unsafe working conditions, unreasonable delays, or breach of agreement.
Notice
Written notice of termination is required. Unless otherwise agreed, a seven (7) day notice period applies.
Payment for Work Completed
In the event of termination, the Client agrees to pay for all work completed, materials purchased or ordered, and costs incurred up to the date of termination.
Removal of Materials and Equipment
Upon termination, the Contractor may remove unused materials and equipment unless otherwise agreed in writing.
Final Invoice
A final invoice will be issued for completed work and outstanding balances, payable within 15 days of receipt.
Dispute Resolution
Both parties agree to make reasonable efforts to resolve disputes through discussion or mediation prior to pursuing legal action.
13. Payment Terms
Unless otherwise stated on the quote or invoice, payment is due upon completion of the work.
For larger projects or where materials must be ordered in advance, progress payments or deposits may be required as outlined in the quote or invoice.
Invoices not marked as due upon completion will indicate the applicable payment terms. Late payments may be subject to additional charges where permitted by law.
14. General
These Terms & Conditions apply to all services provided by Wilkinson Home Solutions unless otherwise agreed in writing.
